Stonegate Pub Company acquisition of Ei Group referred for phase 2 investigation

On 11 October 2019, the CMA a phase 1 investigation into the anticipated acquisition by Stonegate Pub Company Limited of Ei Group plc due to concerns that the proposed transaction could limit options and competition for pub goers. At phase 1, the CMA that, whilst the transaction does not raise UK-wide concerns, the proposed transaction could reduce competition in 51 local areas. As a result, the CMA has decided that it will refer the proposed transaction for a phase 2 investigation unless the parties offer acceptable undertakings to address the above competition concerns. The deadline for the parties to suggest acceptable undertakings is 13 December 2019.
