Standard contractual clauses and binding corporate rules—EU methodology—flowchart This Flowchart reflects the methodology set out by the European Data Protection Board (EDPB) for determining whether you can make an international transfer of personal data on the basis of standard contractual clauses (SCCs) or binding corporate rules (BCRs). You can only rely on these transfer mechanisms where the protections, enforceable rights and legal remedies provided to individuals in the recipient country are essentially equivalent to those guaranteed under the General Data Protection Regulation (GDPR). The ‘essentially equivalent’ test was laid down in the case of Facebook Ireland and Schrems (Schrems II), which was decided under the EU GDPR. The Information Commissioner’s Office (ICO) has published Guidance on transfer risk assessments, which adopts the term ‘sufficiently similar’ in relation to transfers under the UK GDPR and uses a different methodology. Money Laundering Regulations 2017—scope and application This Practice Note sets out the scope and application of the Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017 (MLR 2017), SI 2017/692, as amended. Scope The MLR 2017 form part of the UK’s overall anti-money laundering (AML), counter-terrorist financing (CTF) and counter-proliferation financing regime. They set administrative requirements which run parallel to the criminal element of the regime contained in the Proceeds of Crime Act 2002 (POCA 2002), the Terrorism Act 2000 (TA 2000) and various pieces of sanctions legislation. Singapore—‘Kitchen Sink’ challenges counterproductive (Haide Building Materials Co Ltd v Ship Recycling Investments Inc)

Arbitration analysis: the High Court of Singapore in Haide Building Materials Co v Ship Recycling Investments Inc (Haide) refused to set aside an arbitral award and reiterated that multiple grounds of challenge do not add to the merit of the attack and are ‘seldom productive’. The applicant unsuccessfully argued that the tribunal had breached the rules of natural justice in three ways, the award was induced by fraud and the procedure adopted by the tribunal was contrary to that agreed by the parties. The court found there to be no merit in any of the grounds, upheld the award and imposed costs on the applicant, noting the recent approach of the English Court of Appeal of refusing to entertain meritless multipronged applications.
