This Checklist assumes that the employer has entered into a written contract with a main contractor for construction works which are not yet complete, and that the contractor has engaged sub-contractors. It assumes that it is not a PFI project. The actions to be taken in any specific situation will of course depend on the terms of the contract(s) between the parties and the status of the works at the time of the employer's insolvency, but this Checklist is intended to provide a starting point for the contractor to consider. Recovering retention—checklist This Checklist sets out the key issues to consider when dealing with the payment or recovery of retention monies. It assumes that the contract is subject to the HGCRA 1996 and primarily refers to employer–contractor retention monies, although the same issues also apply to contractor–sub-contractor retention monies. See Practice Note: Retention of payment in construction contracts for an explanation of retention, when it is usually paid, and the way retention is dealt with under JCT and NEC contracts. • What does the building contract say? At the outset, check the provisions of the building contract surrounding retention. The most common arrangement is that the retention monies are due in two halves: the first 50% is payable after practical completion of the works, and the remainder after completion of any defects notified during the defects period. Is a contractor entitled to an extension of time if construction works are delayed due to the impact of coronavirus (COVID-19)? The answer depends entirely on the contract between the parties. Standard form contracts provide for the granting of extensions of time and these usually include a provision for force majeure which would include the effects of coronavirus (COVID-19). The JCT standard forms of building contract contain an extension of time provision which defines the contractor’s entitlement to an extension of time by reference to ‘relevant events’. The definition of relevant events includes ‘force majeure’. The JCT standard forms do not contain a definition of force majeure, therefore, it is necessary to consider the common law position as it pertains to frustration. In Davis Contractors v Fareham UDC, the House of Lords gave what is now regarded as the classic definition of the doctrine when it said that frustration: ‘…occurs wherever the law recognises that without default of either party a contractual obligation has become...

This week's edition of Construction weekly highlights includes a statement from the Ministry of Housing, Communities and Local Government (MHCLG) and Building Safety Regulator (BSR) on the classification of higher-risk buildings following a recent case, analyses of the Joint Contracts Tribunal’s (JCT) 2024 editions of its Major Project, Constructing Excellence, and Prime Cost Building contracts, a case in which the Technology and Construction Court (TCC) considered whether to restrain a developer from continuing with and issuing further adjudications against a contractor, and another case in which the TCC dismissed a contractor’s attempt to limit its contractual design responsibility.

Construction analysis: The Technology and Construction Court (TCC) considered a Part 8 application brought by a losing party in an adjudication where declarations were sought as to the extent of a Contractor’s design responsibility under a JCT Design & Build Contract. The TCC held that although there was a ‘warranty’ contained within the Employer’s Requirements stating that the design would be developed up to RIBA Stage 4/4(i), this did not negate the contractor’s overall responsibility for design contained in the contract and thus did not entitle the contractor to a variation, time or additional money in completing the design.
