(6) EMPLOYMENT: LIMITS ON MONETARY AWARDS

Unless otherwise stated, sums in brackets apply if the event(s) giving rise to the entitlement to compensation occurred before 6 April 2016.

        The following sum is prescribed by the Employment Rights Act 1996 s 124(1), (1ZA) as amended by SI 2013/1949 and by SI 2016/288:

  2. Maximum compensatory award payable under s 117(1) or (2) or s 123:

  3. the lower of £78,962 (£78,335) and 52 multiplied by a week’s pay (which is not capped) of the person concerned.

  4. The above rule does not apply if a person is unfairly dismissed as a result of the provisions in ss 100, 103A, 105(3) or 105(6A), which relate to health and safety and protected disclosure cases: Employment Rights Act 1996 s 124(1A) as inserted by the Employment Relations Act 1999 s 37(1).
