Probate claim definition

What does Probate claim mean?

A claim in respect of any contentious matter arising in connection with an application for the grant or revocation of probate or letters of administration.

A probate claim is defined in CPR 57(2) as a claim:

(i) for the grant of probate of a will, or letters of administration of the estate, of a deceased person;

(ii) the revocation of such a grant; and

(iii) a decree pronouncing for or against the validity of an alleged will; not being a claim which is non-contentious probate business.
