Introduction and background

Political advertising has long been a cornerstone of democratic societies, serving as a vital tool for campaigners and parties to communicate their messages and sway voters. However, with the advent of technology and the rapid increase in the use of digital platforms, the nature and reach of political advertising campaigns have undergone great transformation.

This Practice Note examines the advertising and marketing of political campaigns, and explores broadcast and non-broadcast advertising, digital political advertising, direct marketing, and the impact of data protection law on these activities. It considers the legislation applicable to and regulation of political advertising, including the Elections Act 2022 (EA 2022), and the limited remit of the Advertising Standards Authority.
