[17B  Intention as to plea: absence of accused] [17B Power to proceed if accused does not appear to give indication as to plea]

[(1)ÌýÌýÌýÌý This section shall have effect where—

(a)ÌýÌýÌýÌý a person who has attained the age of 18 years appears or is brought before a magistrates' court on an information charging him with an offence triable either way,

(b)ÌýÌýÌýÌý the accused is represented by a legal representative,

(c)ÌýÌýÌýÌý the court considers that by reason of the accused's disorderly conduct before the court it is not practicable for proceedings under section 17A above to be conducted in his presence, and

(d)ÌýÌýÌýÌý the court considers that it should proceed in the absence of the accused.

[(1A)ÌýÌýÌýÌý This section has effect where—

(a)ÌýÌýÌýÌý a hearing is held for the purposes of section 17A,

(b)ÌýÌýÌýÌý the accused does not appear at the hearing,

(c)ÌýÌýÌýÌý any of the conditions in subsections (1B) to (1E) is met, and
